LIST OF INSURANCE COMPANIES WRITING BASIC PROFESSIONAL LIABILITY INSURANCE FOR KANSAS RESIDENT HEALTH CARE PROVIDERS

The seventeen authorized insurers that offer basic professional liability insurance to a majority of Kansas health care providers are listed in the first table below. Two years ago there were more than thirty authorized professional liability insurance companies offering coverage to Kansas health care providers. In the current market, each available insurance company is being very selective in which new policyholders they will accept.

The Health Care Provider Insurance Availability Plan (which is supported by the Health Care Stabilization Fund) will provide basic coverage for any class of Kansas health care provider. The Availability Plan is intended to be the “market of last resort”, requiring health care providers who seek coverage from the Availability Plan to provide evidence that they have been declined by voluntary insurance companies. The cost to the Health Care Stabilization Fund for the operation of the Availability Plan has been $2.7 million for the last two years. All health care providers who pay into the Health Care Stabilization Fund share this cost. If you are unable to obtain the required basic professional liability insurance coverage from one of these insurers, the Health Care Provider Insurance Availability Plan will be able to assist you.
If you do change insurance companies and have any reason to feel uncertain about the new insurance company providing the necessary coverage information and surcharge payment to the Health Care Stabilization Fund, please contact the Fund for assistance. There have been situations that resulted in late or missing coverage documents and surcharge payments for health care providers who changed their basic professional liability insurance company.

All insurance companies included in the above list have been authorized by the Insurance Commissioner to issue basic professional liability coverage to Kansas resident doctors, hospitals and other health care providers who participate in the Fund. Except for the three Risk Retention Groups (RRG*), the policyholders of each of the above insurance companies are specifically protected by the Kansas Insurance Guaranty Association Act. The purpose of the Kansas Insurance Guaranty Association Act is to protect Kansas policyholders should their insurance company become insolvent (subject to the provisions of the Kansas Insurance Guaranty Association Act).
There are several types of insurance companies that are affording basic professional liability insurance coverage to Kansas health care providers. If you have any questions or concerns regarding the insurance company or RRG you have selected or from which you are considering to purchase your professional liability insurance coverage, you should contact the Fire and Casualty Division of the Kansas Insurance Department.

*Risk Retention Groups (RRGs) are required by Kansas law to include the following statement on the front page of any policy issued in Kansas: This policy is issued by your risk retention group. Your risk retention group may not be subject to all of the insurance laws and regulations of your state. State insurance insolvency guaranty funds are not available for your risk retention group.
